Bill Cosby's Court Case Mistrial: Full Story & Must-See Details

Judge Steven O'Neill, of the Montgomery County Court of Common Pleas, declared a mistrial at 10:17 a.m., following a note from jurors saying that they were hopelessly deadlocked on three counts of aggravated sexual assault.

"If the parties previously agreed to stay the civil litigation pending the criminal trial, it is likely that they will continue that stipulation for a retrial", said Priya Sopori, a partner at Greenberg Glusker.

Montgomery County District Attorney Kevin Steele said they'd retry the case. The defense tried to block the deposition from trial, but since there was no written agreement in 2005 with then D.A. Bruce Castor not to charge Cosby, he agreed to the deposition. For instance, it's quite unusual for a prosecutor to file sexual assault charges 12 years after a police investigation. The prosecution put forth thirteen accusers as potential witnesses but only one was permitted to testify: Kelly Johnson, whose story about a 1996 incident is strikingly similar to Constand's own.

Victoria Valentino, another accuser, said she, as well as others, were "devastated" because of the mistrial.

Cosby's defence attorney Brian McMonagle proclaimed: "Justice is real". They may also be able to query jurors about the deliberations in hopes of learning something that may make their arguments more convincing.

The jury had been deliberating for more than 50 hours on whether to convict the fallen TV star, but could not agree whether he had drugged and molested the 44-year-old.

"All Americans accused of a crime are entitled to a trial by a jury of their peers".
